1. Introduction and Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of the pet-grooming services offered by North Paw Grooming Ltd. ("North Paw Grooming Ltd.", "we", "us", or "our"). By booking, purchasing, or receiving any services from North Paw Grooming Ltd., you agree to be bound by these Terms and by any policies, procedures, and service-specific notices communicated to you at the time of booking or service delivery.

If you do not agree to these Terms, do not book or use our services. These Terms apply to all clients, pet owners, and any person acting on behalf of a client.

North Paw Grooming Ltd. provides pet-grooming services in Ontario, Canada, and these Terms are intended to be interpreted in a manner consistent with applicable laws in Canada, including applicable consumer protection, contract, privacy, animal welfare, and other laws of general application.

2. Scope of Services

North Paw Grooming Ltd. provides pet-grooming services, which may include the following:

Bath and brush-out
Breed-specific haircut and styling
Nail trimming and filing
Ear cleaning and paw pad care
De-shedding treatment
Teeth brushing
Sanitary trim

All services are provided based on the condition of the pet, coat type, temperament, health, and safety considerations. We may decline to perform or may modify any service if, in our sole reasonable judgment, the pet’s condition, behavior, age, illness, injury, parasite infestation, or other circumstances make the service unsafe, unsuitable, or impractical.

Service times, pricing, and availability may vary depending on the pet’s size, breed, coat condition, behavior, and the complexity of the requested grooming.

3. User Obligations and Responsibilities

As a client, you represent and warrant that:

You are the lawful owner of the pet or are authorized by the owner to arrange grooming services for the pet.
The pet is up to date on required vaccinations and parasite prevention where applicable and appropriate for the services requested.
You have disclosed all known health conditions, allergies, behavioral concerns, prior grooming incidents, injuries, and special needs that may affect service delivery.
The pet is not infected with contagious parasites or diseases unless such condition has been disclosed in advance and we have agreed in writing to proceed.
You will provide accurate contact, billing, and emergency information and keep it current.

You agree to:

Pick up your pet promptly when notified that services are complete.
Remain reachable during the appointment if required.
Pay all applicable fees in accordance with these Terms.
Inform us of any changes to your pet’s medical or behavioral condition before each appointment.
Comply with all drop-off, pick-up, and appointment policies communicated by North Paw Grooming Ltd.

You acknowledge that grooming may involve inherent risks, including stress, minor nicks, skin irritation, clipper burns, accidental hair loss, or behavioral reactions such as anxiety, movement, or resistance. While we take reasonable care, these risks cannot always be eliminated.

4. Payment Terms and Conditions

All prices are subject to change without notice, unless otherwise expressly stated in a written quote or service agreement. Applicable taxes, including GST/HST where required by law, will be added to the price of services.

Unless otherwise agreed in writing:

Payment is due at the time services are completed, before the pet is released.
We may require a deposit or pre-authorization to secure certain appointments.
Additional charges may apply for matted coats, excessive coat condition, flea treatment handling, difficult behavior, extended service time, special handling, missed pickups, or other circumstances requiring extra labour or supplies.
Returned or declined payments may be subject to administrative fees and collection costs to the extent permitted by law.

If a pet’s condition requires services beyond the original request, we may proceed with additional services if reasonably necessary for the pet’s well-being, appearance, hygiene, or safety, and we may charge accordingly. We will attempt to contact you where practical, but your authorization to proceed may be implied by booking the service and leaving the pet in our care, subject to applicable law.

5. Cancellation and Refund Policy

Appointments may be cancelled or rescheduled according to our then-current booking policy. We may require advance notice for cancellation or rescheduling. Missed appointments, late arrivals, or same-day cancellations may incur a fee or forfeiture of a deposit.

Refunds, if any, are issued at our sole reasonable discretion and in accordance with applicable law. Due to the nature of grooming services, completed services are generally non-refundable. However, if a service is not provided due to our error or operational inability, we may offer a refund, re-service, or credit, as appropriate.

No refund will be provided for issues arising from undisclosed pet conditions, inaccurate information, or refusal to comply with pickup, payment, or safety requirements. Any concerns about service quality must be communicated promptly so we may review and, where appropriate, address the matter.

6. Liability Limitations

To the fullest extent permitted by applicable Canadian law, North Paw Grooming Ltd. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of use, emotional distress, or reputational harm, arising out of or relating to the services or these Terms.

While we exercise reasonable care in handling pets and performing services, you acknowledge and agree that grooming may result in unavoidable or incidental effects, including but not limited to:

Minor cuts, nicks, or abrasions
Clipper irritation or burn
Stress-related reactions, including vomiting, trembling, or distress
Mat removal-related skin sensitivity or hair loss
Accidental alterations in coat length or style

Our total liability for any claim arising from or relating to the services shall, to the extent permitted by law, be limited to the amount actually paid by you for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or other liability that cannot lawfully be excluded.

You agree to indemnify, defend, and hold harmless North Paw Grooming Ltd. and its directors, officers, employees, contractors, and agents from and against claims, damages, losses, liabilities, costs, and expenses arising from your breach of these Terms, your pet’s behaviour, or your failure to disclose material information, except to the extent caused by our gross negligence or wilful misconduct.

7. Intellectual Property Rights

All content, branding, text, images, graphics, documents, procedures, forms, designs, and other materials provided by North Paw Grooming Ltd., whether displayed online, in print, or otherwise, are owned by or licensed to North Paw Grooming Ltd. and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, transmit, publish, display, or create derivative works from our materials without our prior written consent, except where permitted by applicable law. Any feedback, suggestions, or testimonials you provide may be used by North Paw Grooming Ltd. for business purposes, subject to applicable law and our privacy obligations.

8. Data Protection and Privacy

North Paw Grooming Ltd. collects, uses, discloses, and retains personal information in accordance with applicable Canadian privacy laws, including, where applicable, the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy laws.

In such circumstances, we may reschedule appointments, suspend services, or take other reasonable steps as necessary. We will make commercially reasonable efforts to notify affected clients as soon as practicable.

10. Changes to Terms

We may revise these Terms from time to time to reflect changes in our services, operations, or applicable law. The updated Terms will be effective when posted, when communicated to you, or on the effective date stated in the revised version, whichever applies.

Your continued use of our services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you should not book or use our services after the effective date of the revised Terms.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them, the services, or any related transaction shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts of Ontario, located in or having jurisdiction over the Region of Halton or such other venue as may be appropriate under applicable law, shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or related to these Terms, subject to any mandatory consumer protection rights that cannot be waived under applicable law.

13. Severability Clause
